These Terms of Service (“Terms”) govern your access to and use of AlertCue websites, onboarding forms, reminder services, communication workflows, operational support services, and related services (“Services”). By accessing or using AlertCue Services, you agree to these Terms. If you do not agree to these Terms, do not use AlertCue Services.
1. Services Provided
AlertCue provides informational reminder, communication, and operational support services.
Services may include:

communication workflows
-
operational notifications
-
missed-call alerts
-
automatic text-back messaging
-
appointment reminders
-
customer-configured reminder messaging
AlertCue Services are informational and operational support tools only.
AlertCue does not provide:

healthcare services
-
medical advice
-
medical supervision
-
emergency monitoring
-
crisis response
-
dispatch services
-
legal advice
-
financial advice
-
guaranteed communication delivery
-
life-sustaining services
2. No Emergency or Critical Use
AlertCue Services are not intended for:

emergencies
-
urgent healthcare situations
-
emergency escalation
-
crisis intervention
-
dispatch services
-
life-critical communications
-
time-sensitive medical communications
Customers should always contact emergency services directly when appropriate.
AlertCue Services must not be relied upon for emergency, medical, safety-critical, or life-dependent purposes.
3. Communication Delivery Disclaimer
AlertCue does not guarantee:

message delivery
-
uninterrupted service
-
communication timing
-
response rates
-
service availability
-
business outcomes
-
healthcare outcomes
-
customer responses
-
operational performance
-
lead conversion
-
revenue generation
Services may fail, become delayed, or become unavailable due to:
-
carrier interruptions
-
internet outages
-
telecommunications failures
-
device settings
-
forwarding configuration issues
-
cloud service failures
-
software failures
-
hardware failures
-
cybersecurity incidents
-
power outages
-
third-party service interruptions
Customers acknowledge that communication systems and third-party providers may experience interruptions beyond AlertCue’s control.
4. Customer Responsibilities
Customers are responsible for:

providing accurate information
-
maintaining valid contact information
-
reviewing reminder content
-
ensuring reminder accuracy
-
reviewing automated message wording
-
maintaining phone/device functionality
-
maintaining carrier service availability
-
ensuring proper forwarding configuration where applicable
-
reviewing communication recipients
-
ensuring compliance with applicable laws regarding communications
Customers are solely responsible for all decisions, communications, actions, outcomes, reminder content, and workflow instructions submitted to AlertCue.
5. Authorization of Third-Party Information
By providing information regarding another individual, family member, employee, recipient, or support contact, you represent and warrant that you have authorization to provide such information and consent for AlertCue to communicate with those individuals regarding the requested Services.
6. Automated Communications Consent
By submitting onboarding information or using AlertCue Services, you expressly consent to receive:

automated calls
-
automated text messages
-
emails
-
reminder notifications
-
onboarding communications
-
operational communications
-
billing-related communications
Message and data rates may apply.
Consent to automated communications is not a condition of purchasing any goods or services.
Customers may opt out of text communications by replying STOP where applicable or by contacting AlertCue support.
Customers are responsible for ensuring their devices and carriers can receive communications.
7. Payment Terms
Setup fees are non-refundable once onboarding, configuration, testing, setup work, or operational review has begun.
Subscription services continue until cancelled according to the cancellation policy.
Customers are responsible for maintaining valid payment methods and current billing information.
Failure to maintain valid payment methods may result in suspension or termination of Services.
8. Cancellation
Customers may request cancellation according to the cancellation policy posted on the AlertCue website.
AlertCue reserves the right to suspend or terminate Services at any time for:

operational reasons
-
technical issues
-
security concerns
-
compliance concerns
-
abuse
-
misuse
-
non-payment
-
unlawful activity
-
excessive operational risk
9. Acceptable Use
Customers may not use AlertCue Services for:

unlawful activity
-
spam communications
-
deceptive messaging
-
harassment
-
impersonation
-
emergency communications
-
medical emergency monitoring
-
fraudulent activity
-
unauthorized communications
-
unlawful marketing activity
-
abusive or harmful conduct
AlertCue reserves the right to suspend or terminate Services for violations of these restrictions.
10. Privacy
Customer information may be stored and processed using third-party providers including:

Google Workspace
-
Stripe
-
Twilio
-
communication providers
-
website hosting providers
-
operational software providers
-
analytics providers
AlertCue does not sell customer personal information.

11. Referral & Limited Availability
AlertCue currently accepts onboarding requests through referrals, limited availability, and select service areas.
Submission of onboarding information does not guarantee service acceptance, activation, or continued availability.
AlertCue reserves the right to decline onboarding requests at its discretion.
12. Limitation of Liability
To the maximum extent permitted by law, AlertCue shall not be liable for:

missed reminders
-
failed communications
-
delayed notifications
-
business interruption
-
lost profits
-
lost revenue
-
healthcare outcomes
-
customer decisions
-
emotional distress
-
indirect damages
-
incidental damages
-
consequential damages
-
punitive damages
-
data loss
-
third-party service failures
Use of AlertCue Services is at the customer’s own risk.
13. Service Availability
AlertCue currently supports:

United States customers only
-
Pacific Time Zone operations only
Availability may change without notice.
14. Force Majeure
AlertCue shall not be liable for interruptions, delays, or failures caused by circumstances beyond reasonable control, including:

internet outages
-
telecommunications failures
-
carrier failures
-
cloud service interruptions
-
natural disasters
-
labor disputes
-
governmental actions
-
cybersecurity incidents
-
software failures
-
power outages
-
third-party service disruptions
15. Minimum Age Requirement
AlertCue Services are intended only for individuals age 18 or older.
By using AlertCue Services, you represent that you are at least 18 years old or are legally authorized to act on behalf of the individual, family member, recipient, or business receiving Services.
16. No Professional Relationship
Use of AlertCue Services does not create:

a healthcare provider relationship
-
attorney-client relationship
-
fiduciary relationship
-
advisory relationship
-
emergency-response relationship
-
agency relationship
Customers remain solely responsible for all healthcare, legal, financial, operational, and emergency-related decisions.
17. No Warranty
AlertCue Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
To the maximum extent permitted by law, AlertCue disclaims all warranties, including:

merchantability

fitness for a particular purpose
-
non-infringement
-
uninterrupted availability
-
accuracy
-
reliability
18. Service Modifications
AlertCue may modify, suspend, limit, or discontinue any portion of the Services at any time without guaranteed notice.
AlertCue is not liable for modification, suspension, interruption, or discontinuation of Services.
19. Modifications To Terms
AlertCue may update these Terms periodically.
Updated Terms become effective upon posting.
Continued use of Services constitutes acceptance of updated Terms.
20. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles.
